TERMS & CONDITIONS

 

The following terms and conditions shall apply in respect of all of Imago Garage srl workshop and tour bookings and will form the basis of your contract with Imago Garage srl.

 

This Contract is entered into by Imago Garage srl and the Client. Imago Garage srl’s contact details are as follows:

1. DEFINITIONS

   1. Workshop means the service being offered by Imago Garage srl as advertised on the website to the Client. Note that workshop bookings from this website are made with Imago Garage srl.

   2. Client means any customer or business placing an order with Imago Garage srl, or on behalf of whom an order has been placed.

   3. Booking means the completed process through which the Client completes a registration/booking form, sends payment to Imago Garage srl, and receives confirmation in writing that a booking is complete.

   4. Force Majeure means any unforeseen or unusual circumstances beyond the control of Imago Garage srl such as war or threat of war, terrorist activity, riot, civil strife, industrial dispute, natural or nuclear disaster, fire, flood or adverse weather.

   5. Under-booking is the situation in which the minimum number of bookings required to run a workshop is not met, we require a minimum of 5 people enrolled.

2. BOOKINGS AND PAYMENTS

   1. A non-refundable deposit of €800 is required at the time of booking. Booking fees payment details to be included in this Booking Form.

   2. The balance of the workshop price is due 2 months prior to the commencement date. If the final payment is not made by the date specified, Imago Garage srl reserves the right to treat the booking as cancelled and retain the deposit. If a booking is made 2 months  or less prior to the departure date, then the full amount is payable at the time of booking.

   3. The receipt of a deposit does not imply acceptance of a booking. Acceptance of your booking will be made in writing (via email) by Imago Garage srl.

   4. For special dietary or other requests, please fill in the relevant booking form section and/or inform by email Imago Garage srl of these prior to departure.

   5. Imago Garage srl reserves the right to change any of the prices, service or other particulars contained in this at any time before we enter into a contract with the Client. If there is any change, Imago Garage srl will notify the Client before entering into such contract.

   6. Bookings are non-transferrable between participants and/or workshops unless specifically agreed with Imago Garage srl.

   7. Payment method,Bank transfer to the following IBAN:    IT34S0306935274100000000547. 
      In the payment description please enter the following: "deposit for South Coast Workshop Iceland 2020" including your full name.

   8. We are unable to accept bookings from persons under 16 years old unless accompanied by the legal guardian.

3. CANCELLATIONS / AMENDMENTS

   1. Any cancellation by the Client must be made in writing. The date on which the letter/email is received will determine the cancellation charges applicable. These charges are expressed as a percentage of the total workshop price, and are as follows:

       

      4-6 weeks before  50%

      Less than 4 weeks (28 days) before 100%.

       

   2. Imago Garage srl reserves the right to alter or cancel any workshop. If an alteration or cancellation becomes necessary, you will have the choice of accepting the change, accepting an alternative workshop offered by Imago Garage srl  (of equal or lesser value, and where this is of a lower value we will refund the difference), or withdrawing from the contract and accepting a refund of all monies paid to Imago Garage srl minus the retainer fee and any fees incurred by using an online processor such as Paypal or bank transfer.

   3. Minimum number of participants to the workshop is specified in section 1.5. Such specification is binding on the Client, and if the minimum number of participants is not met Imago Garage srl reserves the right to cancel the workshop as described in section 3.2

   4. In the event of Imago Garage srl being unable to attend due to illness or other circumstances beyond Imago Garage srl’s control, then the workshop will be cancelled, and the provisions of clause 3.2 will come into effect.

4. LIABILITIES

   1. Photography workshops require flexibility and must allow for alternatives. For this reason, the outline itinerary/description must be taken as an indication of what may take place, and not as a contractual obligation on the part of Imago Garage srl.

   2. Imago Garage srl does not accept liability for any loss or additional expense caused by delay or interruption to travel services through weather conditions, civil disturbance, industrial action, strikes, wars, floods, sickness or force majeure. Such losses or additional expenses are the responsibility of the Client.

   3. Imago Garage srl does not accept responsibility or liability for death, bodily injury or illness caused to the Client or any other person included in the booking in the course of a workshop or in transit thereto. 

   4. By booking with Imago Garage srl, the Client acknowledges that there is always an element of risk associated in any outdoor workshop. The Client at the time of making the booking with Imago Garage srl accepts that not only the Client but all individuals in the party are fit to travel and are completely aware of any risks associated with field locations and weather.

   5. It is the responsibility of the Client to inform Imago Garage srl at or before the booking whether it is necessary to make any special arrangements as regards care or assistance with regard to the Client or any individuals in the Client’s party.

   6. All workshops require some personal fitness. The nature of landscape photography often requires at least some level of walking around locations and obviously you need to factor in the weight of carrying your equipment as well. It is the responsibility of the Client to inform Imago Garage srl at or before the booking whether it is necessary to make any special arrangements as regards any special mobility considerations.

   7. Imago Garage srl reserve the right to assess whether the Client or any individuals in the particular party can be safely accommodated on the workshop. Imago Garage srl have an absolute discretion to refuse that Client’s attendance or any member of that Client’s party on the workshop.

   8. Please note that suitably qualified medical personnel do not accompany Imago Garage srl workshops. Bookings made with Imago Garage srl are not equipped or trained to deal with a medical emergency or to provide care and assistance in the event of an emergency. If you have any medical condition which may need emergency treatment, then you must disclose this at the time of booking to enable Imago Garage srl to make an assessment as to whether you can be safely accommodated on the workshop.

   9. By booking with Imago Garage srl, the Client acknowledges items 4.1 – 4.7 and releases Imago Garage srl from any liability. Imago Garage srl will assume no liability for death, injury, illness or loss of personal property or expenses thereof associated with his workshops.

   10. The nature of landscape photography means that workshops will inevitably take place in locations where we are often at the mercy of natural elements such as weather, tides and terrain. As such appropriate waterproof clothing, strong footwear such as walking boots and general protection from these elements should be born in mind and is the Client’s responsibility. Imago Garage srl will provide, at the time of booking confirmation, a list of recommended items (clothing and equipment).

   11. Imago Garage srl does not accept any responsibility for less than perfect weather conditions during the workshop. The Client should come prepared for changeable conditions including periods of rain a possible snow.

   12. Personal items, valuables and baggage, including photographic equipment, remain the responsibility of the Client at all times. Imago Garage srl will not accept responsibility for any loss of personal items, valuables or baggage, including photographic equipment, during the Client’s chosen workshop.

   13. By entering into this Contract, the Client accepts responsibility for any equipment loaned to the Client by Imago Garage srl during the workshop, and the Client must pay for any loss or damage caused to this equipment whilst in the Client’s possession.

5. INSURANCE AND TRAVEL

   1. Travel booking (Flight/rail /bus ) is the Client’s responsibility and Imago Garage srl is not responsible for any expenses, loss or other damage caused to you by the acts or omissions of the carrier.

   2. Travel, personal medical and equipment insurance must be arranged by Client before the workshop commences. It is the responsibility of the Client to ensure that any insurance provides the appropriate cover/amount of cover. The insurance must cover the loss, expenses and damages arising from, including but not limited to, the cancellation of the workshop (whether in whole or in part), personal accident and injury, medical costs, loss or damage of equipment and personal money and belongings.

   3. It is the responsibility of the Client to ensure that they arrive at the agreed meeting point (house, hotel, or other agreed location) on time. Imago Garage srl cannot be held responsible for the late arrival of Clients. If Clients arrive late Imago Garage srl reserve the right to commence the workshop and accept no liability for expense incurred in Clients arranging their own transport in such an eventuality.

6. DISPUTES

   1. The Client must communicate any perceived failure in the performance of this contract on the spot to the workshop leader thus giving the leader the opportunity to achieve a satisfactory solution. Should this not be possible, you should make your complaint known to Imago Garage srl in writing within 28 days of the completion of the workshop.

   2. By completing this online booking, you are agreeing to accept all the above conditions and hereby agree to enter into a contract with Imago Garage srl as detailed above. The person who completes the booking does so on behalf of all the individuals included on it, so that all are bound by the booking conditions. This Contract is subject to normal terms and conditions as a written contract would be.

   3. Imago Garage srl will store the Client’s details on a private internal database. These details will not be made available to companies or individuals out-with Imago Garage srl.
